The teachers service commission, TSC, has released statistics of teachers who preyed on students in 2021. The commission has also threatened to publish photos of the teachers in newspapers and media, as a measure of cubbing the act.

TSC claims that cases of sexual intercourse between teachers and students is on the rise, with some 282 teachers being sacked and degazetted over the last three years. Overall, a total of 485 teachers have been deregistered by the TSC for engaging in unethical behaviour, including engaging in sex with minors since 2015.

It is emerging that students are lured into sexual activities by teachers they are close to, and those who offer small favours such as public recognitions and monetary gifts.

Research conducted by TSC reveals that sexual acts involving teachers and students occur mostly after night preps at night preps and at games time. For day schools, teachers book rooms where they meet school girls and defile them, or the girls visit them in their houses at night.

According to the TSC data, in the last three years, Siaya and Murang’a counties had the highest number of teachers accused of defilement.

Each of the two counties recorded 16 cases. Nakuru came third with 15 defilement cases followed by Kakamega with 13, Busia and Kitui each with 12, and Homa Bay with 11 cases.

Vihiga, Narok, Meru and Bungoma counties each had 10 defilement cases, according to TSC. Other counties with a high number of defilement cases are Machakos with nine, Kirinyaga and Makueni with eight each while Kiambu, Kisii, Migori and Kisumu each recorded seven cases.

Nyandarua, Tharaka Nithi and Kilifi followed with six while Embu had five cases.

TSC data also shows that the highest number of sexual harassment cases was recorded in 2019 with 124 teachers being sacked and deregistered.

In various gazette notices released by TSC, it has cautioned that any person who hires deregistered teachers shall be jailed. The commission also threatened to publish names and photographs of teachers found guilty of sexually harassing children.

Regulations 18 (1) (c) and (d) of the TSC code of regulations, read together with Section 45 of TSC Act, sets penalties for persons committing such teachers to service again.

“Any person who suffers or permits or employs in any school a person not being a registered teacher shall be guilty of an offence and eligible to a fine not less than Sh100,000 or to imprisonment for a term not exceeding two years or both,” reads a notice by TSC.

The Teachers Service Commission, TSC has de-registered 43 more teachers for various professional misconducts and has warned private and public schools against hiring them.

In a Gazette Notice dated October 22, TSC chief executive Nancy Macharia said the affected teachers will immediately cease from being bonafide teachers.

“In exercise of powers conferred by section 30 (1) (e) of the Teachers Service Commission Act, the Commission wishes to notify the public that the persons whose names are specified in the Schedule herein below have been removed from the Register of Teachers,” reads the notice signed by Macharia.

Macharia has also warned heads of learning institutions against employing the removed teachers or risk being jailed.

“It is against the law to employ in any school a person not being a registered teacher and the school heads found doing that shall be liable to a fine of not less than Sh100,000 or to imprisonment for a term not exceeding two years or to both,” she said in the notice.

According to TSC Act section 30 (4) and (5) and section 23, a teacher removed from the register shall not be reinstated except by the direction of the Commission.

The Acts also state that the affected individuals cease to be teachers with effect from the date of such removal and are not authorised to engage in the teaching service unless such a person is re-registered as a teacher by TSC.

In May 2021, another 52 teachers lost their job after being de-registered over indiscipline cases while in November 2020, another 50 were fired over the same.

A total of 26,000 teachers have been targeted to be trained on coaching and mentorship in what can be seen as a humanistic approach that Teachers Service Commission (TSC) is employing in dealing with indiscipline cases among teachers.

The programme is meant to target new teachers joining the teaching service notably new recruits, those in internship and those joining the administrative positions of leading the institutions and those having challenges in performance.

Teachers will be trained in three financial years starting with 2021/22 financial years to 2023/24 which will target a total of 13,000 teachers in each financial year. According to the Commission Secretary, Dr. Nancy Macharia, the many hours wasted in form of teacher-learner contact time results in poor learning outcomes and a drop in performance at all levels.

“To address this challenge, the Commission, in its Strategic Plan 2019 -2023, committed to implement mentorship and coaching as a preventive strategy that pre-empts indiscipline amongst teachers rather than corrective mechanisms in management of discipline,” states Dr. Macharia in the policy document.

The programme is also expected to target a total of 12,000 School administrators and Boards of Management (BoMs) who will be trained on management of discipline cases, and this will capture a total of 4,000 teachers in each financial year till 2024 with 2021/22 being the baseline year.

Unlike before where the commission used a decentralized system whereby indiscipline cases were being heard at County and Regional office – which saw some cases taking long before being concluded – this time the commission has decided to mentor and coach teachers joining the services using their fellow teachers who have been in service for a while.

A lot of indiscipline cases among teachers results to insubordination whereby teachers being reported for not taking duties, missing lessons, alcoholism and drug abuse, absenteeism among others. In 2019, a total of 89 teachers were deregistered from the TSC register while last year a total of 71 teachers were deregistered after their disciplinary cases were concluded by the commission.

According to TSC code of conduct and ethics regulations for teachers, a teacher is supposed to ensure that his or her private and public conduct upholds the dignity and integrity of the teaching service.

The code further requires teachers at all times be of good conduct whether or not on official duty and in particular; maintain a neat and decent standard of dressing which befits the dignity and image of the teaching service, ensure that their personal hygiene is not offensive to workmates or those they serve, observe official working hours, be punctual and meet deadlines and not being absent from duty without permission among others. On the other hand, the commission will train a total of 30,000 newly appointed heads of institutions on the programme and which will capture 10,000 heads in each financial year starting 2021/22 which starts in 1st July 2021 up to June 2024. A total of 2000 teachers who have already undergone indiscipline process will also be trained on mentorship and coaching in these financial years, targeting a total of 6,000 teachers under this category.

The programme will be implemented on a cascade model, where by National Trainers (NTs) will trainer Master Trainers (MTs) at regional and County who in turn will train trainers of Trainers (TOTs).

“This approach provides a structured way of engagement where institutions will benefit from skills of an experienced teacher/professional with unique and exemplary performance within the immediate environment/county/ region,” reads the TSC policy document on mentorship and coaching in part.

According to the Basic Statistical Booklet of 2019 released by the Ministry of Education, there are 218,760 teachers in Public Primary schools as per 2019 of which 104,684 are male while 114,076 are female, while in public Secondary schools, there were a total of 105,234 teachers of which 62,110

are male and 43,124 females.

Among The offences committed by these teachers were misappropriation of funds, intolerable code of conduct, immoral behavior and chronic absenteeism. TSC is threfore felt that they have breeched the code of conduct and regulations.

The deregistered teachers were granted virtual hearings by the teachers’ service commission in the month of October 2020 before being declared guilty. Also present, were their witnesses.

The teachers service commission maintains that after hearing the cases of the teachers, it was left with no options but with draw their TSC certificates.

Having been deregistered, their TSC numbers were revoked and therefore, they are not allowed to teach in any learning institution.
